These Terms of Service (the “Terms”) govern your access to and use of the ImmerGround mobile application and related services (the “Service”) operated by ImmerGround (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.
2. Your account
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
3. Acceptable use
- Do not use the Service for any unlawful purpose.
- Do not attempt to interfere with, disrupt, or compromise the integrity or security of the Service.
- Do not reverse engineer, decompile, or attempt to derive source code from the Service except as permitted by law.
4. Intellectual property
The Service and all related content, features, and functionality are owned by ImmerGround and its licensors and are protected by copyright, trademark, and other applicable laws. Audio you create with the Service belongs to you.
5. Subscriptions and payments
If the Service offers paid features or subscriptions, payments are processed by the App Store. Subscriptions auto-renew unless cancelled, and you can manage or cancel them in your App Store account settings.
6. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or for any other reason at our discretion.
7. Disclaimer
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, to the fullest extent permitted by law.
8. Limitation of liability
To the maximum extent permitted by law, ImmerGround shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
9. Changes to these Terms
We may modify these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
